Neil Rees

Practice Overview

Neil’s principal areas of practice are personal injury and fatal accidents. He acts for both Claimants and Defendants in claims involving the RTA, EL/PL, OLA, and the FAA and accepts instructions on the small claims track, fast track and the multi-track.

Neil accepts instructions under a CFA and has a particular interest in liability disputes and has developed a specialism in acting for motorcyclists and cyclists.

In addition to his core practice areas, Neil is building a practice in most areas of civil litigation having represented parties in clinical negligence, PPI mis-selling, housing disrepair, and contractual disputes.   He also advises on professional conduct matters.

Neil is instructed on several cases pleaded in excess of £100,000 and has drafted schedules of loss exceeding £500,000.  He has a national practice and is happy to travel to court and to meet clients at their home if required.

Neil is always happy to talk through a potential instruction with the instructing party before becoming formally engaged if desired.

Prior to his call to the Bar, Neil worked as a solicitor for 12 years and qualified as a solicitor-advocate in 2017.  He specialised in serious and catastrophic injury claims and was involved in multi-million pound settlements. He was also responsible for delivering MOJ training and supervision to more junior lawyers which provided him with a broad knowledge of claims of all values.  His time as a solicitor provided an in depth understanding of both his professional and lay client’s needs, and an invaluable appreciation of the commercial practicalities that face both Claimants and Defendants in litigation.

Notable and Reported cases

  • EE V ZI

Neil was instructed by a Defendant insurance company to defend a claim for vehicle damage.  Liability was admitted but quantum was in dispute. Neil successfully argued that whilst damages were payable, the Claimant’s conduct in litigating the matter through to trial was unreasonable such that the Court debarred the Claimant from recovering any of his costs of the litigation and the Claimants solicitors were ordered to pay Neil's brief fee.

  • MJ v JD

Neil was instructed to act for a Defendant in road traffic accident when it was alleged that the Defendant had overtaken the Claimants stationary vehicle whilst it was waiting for oncoming traffic to pass.  Neil was able to establish the plausibility that the accident had occurred in a manner other than that which had been suggested by the Claimant such that the Claimant had failed to prove her case and the case was dismissed.
