Practice Overview

Adem joined Chambers in 2017 after relocating to the Cardiff area from Birmingham. He is ranked as a leading junior in the Legal 500, being described as an advocate who is “expressive and passionate” in court. Adem was shortlisted for Regional Junior of the Year at the 2018 Legal 500 Awards.

The primary focus of Adem’s practice is family law, with an emphasis on private law children and financial remedy work. He has developed a specialist practice in respect of the law relating to surrogacy and assisted reproduction, and receives instructions from across the country to advise and represent clients in this area.

Adem was appointed as a Deputy District Judge in 2015, and sits in both the County Court and Family Court.

Adem is qualified under the Bar Council’s Public Access Scheme and is able to accept instructions from prospective clients directly.

  • Re C (2017)

    Proceedings involving a child with a disputed diagnosis of gender dysphoria.

    Declarations of parentage made following administrative errors by various fertility clinics.

  • Re Z (A Child) (No 2) [2016] EWHC 1191

    Instructed as junior counsel on behalf of the applicant. Declaration of Incompatibility obtained in respect of sections 54(1) and (2) of the Human Fertilisation and Embryology Act 2008.

    The issue was whether a single applicant could obtain a Parental Order in respect of a child conceived through surrogacy. The applicant successfully obtained a Declaration of Incompatibility on the basis that the relevant legislation is incompatible with Article 14 taken in conjunction with Article 8 ECHR.

    A remedial order will change the law during the course of 2017. The Declaration of Incompatibility in this case is one of only 20 final declarations to have been made since the implementation of the Human Rights Act 1998.

  • Re JMM (2016)

    Instructed on behalf of the mother of a 17-year-old who fled Canada to the United Kingdom following protracted proceedings and findings of parental alienation. The contested final hearing dealt with issues of comity, the principles to be applied in non-Hague Convention cases, the limitations of Wardship, and the court’s powers to enforce an order against a Ward. Against both silk and a leading junior counsel instructed on behalf of the child.

  • Re Z (A Child: Human Fertilisation and Embryology Act: Parental Order) [2015] EWFC 73

    Test case before the President of the Family Division, where it was held that a single applicant father was unable to apply for a Parental Order. 

  • Family and Childcare

    Adem is instructed in complex and intractable private law disputes. His experience includes:

    • Cases featuring serious non-accidental injuries
    • Parental alienation and emotionally conflicted children
    • Disputes as to habitual residence
    • Child abduction: Brussels IIR, Hague Convention, and non-Convention cases
    • Wardship proceedings
    • Internal relocations
    • Leave to remove from the jurisdiction (including temporary removals to non-Hague Convention countries)

    Adem has a keen interest in the development of law and policy relating to surrogacy and assisted reproduction. He has advised and represented applicants for parental orders following both domestic and international surrogacy arrangements, and recently appeared as junior counsel in the single applicant test case Re Z (A Child) (No 2) [2016] EWHC 1191.

    Adem has been instructed on behalf of both applicants and fertility clinics in applications for declarations of parentage following administrative failings by clinics. Adem appeared as junior counsel in Re HFEA (Cases AD, AE, AF, AG and AH: No. 2) [2017] EWHC 1782 (Fam), in which the President of the Family Division gave practice guidance in straightforward applications for declarations of parentage.

    Adem has acted on behalf of parents following the breakdown of same-sex parenting arrangements, and is well-versed in the specific legal and factual challenges that such cases present.

  • Cohabitee and Matrimonial Finance

    Adem’s practice encompasses all aspects of matrimonial finance and cohabitation disputes. He is praised for his eye for detail and keen analytical skills. Adem is proud to be known as a determined negotiator and advocate, but is equally pleased to be regarded as personable and down to earth. Adem’s experience includes cases involving hidden assets both at home and abroad, pre and post-nuptial agreements, disputes in respect of property owned by third parties, and enforcement.

    Adem is committed to ensuring the right outcome for the individual client. He acknowledges the importance of pragmatic and cost effective compromise, but also recognises when only a fully contested final hearing will secure his client’s interests.

  • Court of Protection

    Adem is developing a practice in Court of Protection work, and has a particular interest in welfare matters and cases involving the deprivation of liberty. 

  • Sports Law

    Drawing on extensive experience as a regulatory crime barrister, Adem has developed a practice in the area of disciplinary proceedings in sport. His experience includes advising a professional footballer and his club in relation to appeal proceedings following the imposition of a 10 match ban for biting an opponent.

    Adem also has a particular interest in team selection issues involving individuals and sports governing bodies. He is able to provide advice and representation to clubs, organisations, sportsmen and sportswomen at all levels of professionalism.

    Adem has been appointed to the Sports Resolutions UK list of advocates. The list is made available to athletes or other individuals with limited means who require advice or representation before a Sports Resolutions or national governing body tribunal. 

    Adem is a member of the British Association for Sport and Law. To demonstrate his commitment to providing the highest quality of advice and representation to both his professional and lay clients, he has enrolled on the BASL-partnered LLM in Sports Law and Practice at De Montfort University.

    Adem is a Registered Lawyer under The Football Association Football Agents Regulations.
