Gareth Jones has a focused Chancery and property practice, with particular expertise in contentious probate, trusts, and land disputes. His work often involves claims under the Inheritance (Provision for Family and Dependants) Act 1975, the Trusts of Land and Appointment of Trustees Act 1996, and disputes concerning proprietary estoppel, undue influence, and estate administration.
He is regularly instructed in complex probate matters, including applications to remove executors and trustees, challenges to capacity, will rectification, and claims involving fraud. Gareth also advises on estate planning, inheritance tax, and trust structures for high net worth individuals and large estates, and has experience handling cross-border succession involving Sharia and Hindu law.
In his property work, Gareth deals with rights of way, easements, boundary disputes, adverse possession, restrictive covenants and shared driveways. He is also instructed in tenancy disputes and property transfers challenged on grounds of undue influence or mistake.
Gareth continues to draw on his earlier City practice to advise on financial matters including banking and insolvency disputes. He also has experience advising charity trustees and unincorporated associations on governance, constitutional updates and regulatory issues, and has chaired and advised in disciplinary hearings, including those involving the dismissal of senior staff.
In addition to his court practice, Gareth is an experienced mediator and is regularly instructed to assist parties in resolving contentious private client and property disputes out of court.
His work is marked by practical, solutions-focused advice and a detailed understanding of the legal and personal sensitivities that often accompany disputes over land and inheritance. Gareth draws on early experience in the City advising banks and financial institutions on fraud, guarantees, securities and enforcement. He also advises on charity law and governance, and has acted as legal adviser to disciplinary panels, including cases involving senior staff and sensitive organisational or regulatory issues.
His practice also covers wills, probate, trusts, and land disputes. He advises on construction of wills, lack of capacity, undue influence, and estate distribution. He is regularly instructed to remove executors and trustees, and handles matters involving Sharia and Hindu succession law. He also advises on tax planning and care fee issues.
Gareth also has extensive experience in disputes over rights of way, easements, restrictive covenants, adverse possession and shared driveways. He acts in TOLATA claims, including cohabitation disputes, and advises on setting aside property transfers made under mistake or pressure. He is also instructed in landlord and tenant matters, including tenancy renewals.
Gareth acts as a mediator in a wide range of disputes. He helps resolve complex or emotionally sensitive disputes involving inheritance, trusts and land. His calm and pragmatic approach makes him particularly effective in mediations involving family members or former partners, where maintaining relationships and finding practical solutions are often key.
