Practice Overview

Eugene specialises in criminal and associated regulatory work. He prosecutes and defends serious criminal cases in the Crown Court. He is a grade 4 Crown Prosecutor. He has a wide range of experience in all aspects of criminal law and has been instructed in trials involving offences of mortgage fraud through to rape, manslaughter and murder. He also has considerable experience in cases where the prosecution is brought by agencies other than the Crown Prosecution Service.

Eugene is often instructed because of an intelligent and analytical approach to his cases and has an ability to take sensible tactical decisions which ensure that his client’s case is advanced in the best possible way.

He was also a very accomplished rugby player and represented Oxford University.

Notable and Reported Cases

  • 2011 – Conspiracy to pervert the course of justice.Defended in a multi-defendant case where an aged drug debt was enforced by defendants from the West Midlands. Issues arose regarding the bugging of prison visits at HMP Cardiff and also as to the hearsay provisions regarding absent witnesses.
  • 2010 - Defended in an Enviroment Agency prosecution. Legal argument as to the vires of the Agency to bring the prosecution. Indictment stayed.
  • 2009 - Fraud relating to £1 million plus purchase of hotel.
  • 2009 - Defence junior to a young defendant who ran his father through with a Samurai sword. Murder charge successfully reduced to diminished responsibility manslaughter.
  • 2008 - Operation Jasmine. Gwent prosecution of a care home worker accused of wilful neglect. World expert on rigor mortis called by defence. Acquitted.
  • 2008 - Operation Jasmine. Prosecution of care home worker. Acquitted. This case was designated a Very High Cost Case (VHCC) as a result of its complexity.
  • 2008 - Operation Pegasus. Defence junior in a VHCC relating to a fraud on a major national retailer.
  • 2006 - Operation Reptile. Defence junior in a 20+ defendant case involving the supply of drugs from Essex/Coventry/Reading into South Wales. Major covert surveillance operation including bugged telephone evidence.
  • 2006 - Court of Appeal Criminal Division. An appeal against conviction concerning breaches of Code D (identification). Reported at [2006] EWCA Crim 2895.
  • 2005 - Defence junior representing the manager of a care home where a young resident had died. Acquitted. Conducted the subsequent Coroner’s Inquest.
  • 2005 - Prosecution junior in the successful prosecution of a defendant charged with murder. Complex issues relating to diminished responsibility arose.
  • 2003 - Defence junior in a case concerning the supply of drugs from London/Essex to Cardiff. Acquitted.
  • 2003 - Prosecution junior in a domestic murder. Issue was provocation  
  • 2002 - Operation Angler. Drugs trial involving a conspiracy to supply drugs in the Caerphilly area.
  • 2002 - Operation Velvet. Represented a primary school teacher accused with others of sexual abuse of a young pupil. Acquitted.
  • 2001 - Defence junior in a domestic murder case. Plea to manslaughter accepted. Conducted the successful appeal against sentence alone
  • 2001 - Defence junior in a multi-defendant case involving the murder of a man outside the Royal Gwent hospital.
  • 2000 - Divisional Court Judicial Review. Argument concerning s.39 of the Children and Young Persons Act 1933. Case reported – see R v Cardiff Crown Court ex.p. M (a minor)(1998) JP 527.
  • 1999 - Operation Vancouver. Conspiracy to burgle trial.
  • 1999 - Defence junior in a murder trial.
  • 1997 - Defence junior in a murder trial. Acquitted – self defence.
  • 1996 - Defence junior in a Health and Safety prosecution following a fire at Milford Haven oil refinery.
  • 1996 - Defence junior in a conspiracy to commit armed robbery (Stafford Crown Court). Indictment stayed following submissions as to the admissibility of the evidence of a “supergrass”.
  • 1996 -Defence junior in a DTI prosecution of a businessman trading while insolvent.
  • 1995 - Defence junior for a financial advisor in a mortgage fraud case at Swansea Crown Court.
